Terms of Service

Effective date: 2026-10-28
This Terms of Service applies to the V6VPS website (v6vps.com, the "Website") and all products and services provided through it. The Website and the V6VPS brand are operated by KKCLOUD L.L.C, a Wyoming limited liability company ("we", "us" or "our").

Please read these Terms carefully before registering, ordering or using our services. By registering an account, checking the box to agree, or using the Services, you confirm that you have read, understood and agree to be bound by these Terms, our Refund Policy and our Privacy Policy. If you do not agree, do not use the Services.

1. Services

Under the V6VPS brand we provide cloud servers (KVM virtual private servers, "VPS"). The Services are IPv6-only: each cloud server has its own public IPv6 addresses and no dedicated or inbound IPv4 address; access to IPv4 destinations is provided through our shared NAT64/DNS64 gateway (outbound only, it cannot be used to serve inbound IPv4 traffic). The configuration, network, data center location, price and delivery of each product are as described on its order page.

2. Accounts

• You must be at least 18 years old, or a legally formed company or organization, and have authority to accept these Terms on its behalf.

• You must provide true, accurate and complete registration information and keep it up to date. We may require identity verification.

• You are responsible for safeguarding your password, API keys and SSH keys, and for all activity under your account. Notify us immediately of any unauthorized use.

3. Export Controls and Sanctions

• You represent and warrant that you are not listed on the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List or any other U.S. government restricted party list, nor owned or controlled by such a person, and that you are not located in, organized under the laws of, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions (currently Cuba, Iran, North Korea, Syria, and the Crimea, so-called Donetsk People's Republic and Luhansk People's Republic regions of Ukraine). In addition, in light of U.S. export controls on Russia and Belarus, we do not provide the Services to users located in Russia or Belarus. We screen registration addresses and access locations and may refuse or terminate affected accounts.

• You may not use, export or re-export the Services in violation of the U.S. Export Administration Regulations (EAR), OFAC sanctions regulations or other applicable export control laws. We may terminate the Services immediately and without refund for any breach of this section.

• You also may not allow any person on those lists, or located in those countries or regions, to use the Services through your account, through services you resell, or through applications you build on them.

4. Orders, Payment and Renewal

• Prices, currency and billing cycles are as shown on the order page. Prices do not include any sales tax, VAT or other taxes that may apply in your jurisdiction; applicable taxes will be shown at checkout.

• Online payments are processed by third-party payment providers (such as Stripe). Your card details are handled directly by the payment provider; we do not store full card numbers.

• Services are prepaid for the billing cycle you select. We never charge you automatically: before a service is due we issue a renewal invoice and email you a reminder, and you renew by paying it yourself. Billing cycles already paid are handled under our Refund Policy.

• If a cloud server is not renewed, it is automatically suspended 5 days after the due date and terminated 7 days after the due date. On termination its data is deleted and its IP addresses are reclaimed, and they cannot be recovered. Please renew before the due date and keep your own backups. We do not charge late fees.

• We may change prices. Changes do not affect a billing cycle you have already paid for; we will notify you by email or in-site notice before any renewal price increase takes effect.

5. Refunds

Refunds are handled under our Refund Policy.

6. Delivery and Use

• Cloud servers are normally provisioned automatically after payment, and the access details are shown in the client area and sent to you by email. If a service cannot be provisioned because of insufficient capacity or a system failure, we will contact you and handle it under our Refund Policy.

• You have full administrative control over the operating system, software, data and content on your servers, and you are solely responsible for their security and lawfulness.

• IP addresses assigned to you remain the property of us or our upstream providers and will be reclaimed when the service ends.

7. Acceptable Use

This section covers the information you (and any company you represent) publish, store or transmit and the network activity you generate when using any of our Services.

7.1 Lawful Use

You must comply with U.S. federal and state law, the laws of the places where the Services are located (Hong Kong and the United States) and the laws of your own location, and you may not access or use the Services by any unlawful means.

7.2 Prohibited Content

You may not use the Services to publish, store, transmit or link to:

• child sexual abuse material (CSAM) — the Services will be terminated immediately and we will report to the National Center for Missing & Exploited Children (NCMEC) under 18 U.S.C. § 2258A;

• terrorist content, incitement to violence or hate content;

• content that infringes copyright, trademarks, trade secrets, publicity or privacy rights (copyright complaints follow the DMCA procedure in Section 8);

• phishing or scam pages, or pages impersonating banks, payment platforms or other organizations;

• malware, viruses, trojans, ransomware or botnet command-and-control;

• illegal gambling, pyramid schemes, unlicensed financial or securities services, or the sale of prohibited or counterfeit goods;

• intimate or sexually explicit images of a person published without their consent, including fabricated or synthetic (“deepfake”) images;

• any other content that violates applicable law.

7.3 Network Security

You may not use the Services to engage in, assist or allow your users to engage in:

• unauthorized access to, or use of, another party's computer systems or networks;

• unauthorized deletion, modification or addition of functions or data on another party's systems;

• unauthorized monitoring or interception of another party's data or traffic;

• launching or taking part in DDoS or amplification attacks, or anything else that prevents a target from operating normally;

• unauthorized port scanning, vulnerability scanning or password brute-forcing;

• forging origin, such as spoofed IP headers, email headers or ARP/MAC addresses, or using IP addresses not assigned to you;

• circumventing any limit we set, including bandwidth, traffic, port and resource limits;

• changing the network configuration we assign (IP, gateway, VLAN, MAC) without permission, or interfering with the data center network or other customers;

• running open proxies, open DNS resolvers or open mail relays that are used for attacks or spam;

• running Tor exit nodes or any other public relay that sends traffic from unspecified third parties out from your server's IP addresses;

• penetration testing, vulnerability scanning or stress testing of our platform, network or other customers without our prior written consent;

• providing or selling DDoS attack or “stress testing” (booter/stresser) services, or using the Services to provide DDoS protection or traffic scrubbing services to others;

• any other activity that endangers computer systems or network security.

• You must take reasonable steps to secure your server (for example keeping software up to date, using strong passwords or key-based login and disabling services you do not need). If a compromised server is used for attacks, scanning, spam or as an open reflector, it is treated as a violation of this section whether or not you intended it: we may suspend the service or cut its network access, and you can clean or reinstall the server through the VNC console while it is suspended and then open a ticket to have it restored.

7.4 Spam and IP Reputation

• You may not send unsolicited bulk email or messages (including email that violates the U.S. CAN-SPAM Act) or forge or hide the sender's identity.

• Bulk email you send must be based on the recipients' prior consent, and you must keep records of that consent and provide them within 72 hours of our request.

• Outbound port 25 (SMTP) is blocked by default. If you have a legitimate need to send email, open a ticket describing your use; it can be enabled after review.

• If your activity causes an IP address to be blacklisted (for example by Spamhaus), you must stop that activity immediately and bear any cost of delisting or replacing the IP.

7.5 Resource Usage

• Cloud servers share resources. You may not saturate CPU, disk I/O or bandwidth for extended periods in a way that affects other customers on the same host.

• Cryptocurrency mining is prohibited on cloud servers.

• Nested virtualization is not supported on cloud servers. You may run containers on your cloud server and may provide its resources (including through containers or port forwarding) to your own users, subject to “Resale and Services to Third Parties” below.

• You may run proxy, VPN or relay services, including for your own users, but they must require authentication: open proxies that anyone can use are not allowed. You are responsible for all traffic and complaints they generate; if they cause our IP addresses to be blacklisted, widely blocked by third parties or the subject of frequent complaints, we may require you to fix this within a deadline and, if necessary, restrict or suspend that use.

• The /64 IPv6 block assigned to each cloud server is the standard IPv6 subnet size (required for stateless address autoconfiguration and similar features) and is provided for use within your own services, for example to give separate addresses to different websites, applications or containers. You may not rotate or spread traffic across large numbers of addresses to evade rate limits, bans or anti-abuse controls of third-party websites or services, to register accounts in bulk, to generate fake traffic, clicks or votes, or to send spam.

• You may not achieve any of the prohibited uses above indirectly, including through tunnels, reverse proxies or changing ports.

7.6 Resale and Services to Third Parties

• You may resell our products or use the Services to provide services to third parties, including reselling whole servers, sharing a server among multiple users, and providing website hosting, proxy, VPN and other application services.

• You are fully responsible for your downstream users and must ensure they comply with this section; a violation by a downstream user is treated as your violation.

• You must have a way to receive complaints and keep the access logs needed to handle complaints and cooperate with investigations.

7.7 DDoS Attacks and Blackholing

When an IP address assigned to you receives an attack beyond our mitigation capacity, we may temporarily blackhole that IP (make it unreachable) to protect the data center network and other customers; it is restored automatically after the attack stops. Interruption during blackholing is not a breach by us and is not compensated.

7.8 Complaint Handling

• When we receive an abuse, infringement or attack complaint, we will notify you by ticket or email. You must reply and resolve it within 24 hours.

• If you do not reply in time, or the case is serious or urgent (for example an ongoing outbound attack, CSAM or phishing), we may suspend the service or cut network access immediately without notice.

7.9 Compliance Checks

• To enforce this section, we may check the ports your server exposes to the public internet and how they respond, and collect network connection metadata (addresses, ports, connection counts and times). We do not log in to your server and do not read any data or communication content on it.

• Our check records (including check times, port responses and connection statistics) form the basis for determining a violation.

• If we find a violation of “Resource Usage” or “Resale”, we may suspend the affected Services without prior notice and state the violation in the suspension reason; repeat violations may lead to termination of the Services or suspension of your account. Services suspended or terminated for violations are not refunded.

• If you believe our finding is wrong, you may appeal by submitting an explanation and evidence through a support ticket and we will review it; if the appeal is upheld, we will restore the Services and extend them by the time they were suspended.

7.10 Enforcement

Depending on the severity, we may warn you, require a fix by a deadline, limit bandwidth or block ports, suspend or terminate the Services, or suspend your account. Services suspended or terminated for violations are not refunded (see our Refund Policy). We reserve the right to pursue legal remedies.

• If your Services or account are terminated for serious or repeated violations, you may not sign up again under another account, identity or agent; if we find such an account we may terminate it without refund.

7.11 Cooperation with Authorities

We may report suspected unlawful activity to law enforcement, regulators or other competent authorities and disclose necessary customer information as required by law. You bear the investigation and handling costs and losses we incur because of your violation, including IP delisting costs and reasonable attorneys' fees.

7.12 Reporting Abuse

To report abuse, attacks, phishing or infringement, email [email protected] with the IP addresses, timestamps and logs involved.

8. Copyright Infringement Notices (DMCA)

We respect intellectual property rights and comply with the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512). If you believe content on the Website or on a customer's server infringes your copyright, send a written notice to our copyright agent at [email protected] that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the specific location of the infringing material (URL or IP address); (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the owner.

Customers whose content is removed may submit a counter-notification as provided by the DMCA. We will terminate, in appropriate circumstances, the accounts of repeat infringers.

9. Data and Backups

• We do not guarantee the security, integrity or availability of the data you store on your servers, and we do not back up your data. You are responsible for regularly backing up all important data and keeping the backups outside the Services.

• Data may be lost or corrupted, possibly permanently, due to hardware failure, software errors, compromise of your server, mistakes by you or us, reinstallation, or suspension, expiry or termination of the service. Data is deleted when a service is terminated and cannot be recovered.

• To the maximum extent permitted by law, we are not liable for, and do not compensate, any loss, corruption or disclosure of data or any resulting damages.

10. Availability and Maintenance

We use reasonable efforts to keep the Services running reliably but do not guarantee that they will be uninterrupted or error-free. We may perform scheduled maintenance and will try to give advance notice by email, ticket or website announcement. We are not liable for interruptions caused by force majeure, upstream network or power failures, third-party attacks or other causes beyond our reasonable control.

11. Suspension and Termination

• You may cancel a service at any time from the client area. Data is deleted after cancellation.

• We may suspend or terminate your services and account if you breach these Terms, fail to pay on time, or engage in fraud or abusive chargebacks.

• If we decide to discontinue a service, we will notify you in advance and refund the unused prepaid portion pro rata to your account balance or original payment method.

12. Intellectual Property

The content, trademarks, logos and software of the Website belong to us or their respective owners and may not be copied, modified or used commercially without permission. Content you upload to your servers remains yours; you grant us a limited license to use it only as necessary to provide the Services.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF DATA OR BUSINESS INTERRUPTION), UNDER ANY LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU ACTUALLY PAID US FOR THE RELEVANT SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE STATES THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

15. Indemnification

You will defend, indemnify and hold harmless us and our members, managers and employees from any third-party claims, losses and expenses (including reasonable attorneys' fees) arising from your or your users' use of the Services, your breach of these Terms, or your infringement of any third-party rights.

16. Privacy

We collect and process your personal information as described in our Privacy Policy.

17. Changes to These Terms

We may update these Terms from time to time and will post the updated version and its effective date on the Website; material changes will be notified by email or in-site notice. Continued use of the Services after the changes take effect means you accept the updated Terms.

18. Governing Law and Disputes

These Terms are governed by and construed under the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The parties will first try to resolve any dispute arising out of or relating to these Terms or the Services informally by email for at least 30 days. If not resolved, the dispute will be subject to the exclusive jurisdiction of the state or federal courts located in the State of Wyoming, USA, and both parties consent to their personal jurisdiction.

TO THE EXTENT PERMITTED BY LAW, EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL AND AGREES TO BRING CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION.

19. Miscellaneous

• These Terms, together with the Refund Policy and the Privacy Policy, are the entire agreement between the parties regarding the Services.

• If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

• Our failure or delay in exercising any right is not a waiver of that right.

• You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets.

• Notices we send to the email address registered on your account are deemed delivered when sent.
